NGER Legislation

The National Greenhouse and Energy Reporting Act 2007 (the NGER Act) introduced a single national framework for the reporting and dissemination of information about the greenhouse gas emissions, greenhouse gas projects, and energy use and production of corporations. A number of legislative instruments sit under the NGER Act, providing greater detail about corporations' obligations.

NGER guidelines

The National Greenhouse and Energy Reporting (NGER) Guidelines provide an introduction to your corporation’s reporting obligations under the NGER Act.

The guidelines apply across industry sectors and cover:

  • Participation - helps to determine whether a corporation meets requirements under the NGER Act.
  • Registration - outlines how and when a corporation must register.
  • Reporting - outlines reporting requirements under the NGER Act.
  • Records highlights the records that corporations may need to keep.
  • outlines how and why a corporation may need to deregister

NGER supplementary guidelines

In addition to the NGER Reporting Guidelines, the Department has prepared the NGER Supplementary Guidelines to provide more detailed guidance on specific topics.

During the first year of the NGER scheme, stakeholders have identified a number of issues that have caused confusion for registered corporations. The NGER supplementary guidelines are to provide corporations with assistance in approaching some of these topics.

NGER technical guidelines

The National Greenhouse and Energy Reporting (Measurement) Technical Guidelines (the NGER technical guidelines) assist corporations understand and apply the NGER (Measurement) Determination 2008. The guidelines outline calculation methods and criteria for determining greenhouse gas emissions, energy production and consumption.

Users of the NGER technical guidelines should note the following:

The guidelines are derived from the Measurement Determination. In cases where a corporation perceives a contradiction between the NGER technical guidelines and Measurement Determination, the Measurement Determination takes precedence.

The National Greenhouse Account Factors have no standing in the application of the NGER legislation.

Two versions of the NGER Technical Guidelines document are provided below. The first is the Technical Guideline released in 2008 which provides guidance for the NGER Determination made on 25 June 2008 and is applicable for the 2008-09 reporting year.

The second is the Technical Guideline for 2009. These Technical Guidelines embody the latest methods for estimating emissions and are based on the National Greenhouse and Energy Reporting (Measurement) Determination 2008 as amended by the National Greenhouse and Energy Reporting (Measurement) Amendment Determination 2009, which in general is applicable for the 2009-10 reporting year.

NGER calculator

What does the calculator do?

The National Greenhouse and Energy Reporting calculator assists corporations to self assess whether or not their corporate group or any of their facilities meet reporting thresholds under the National Greenhouse and Energy Reporting (NGER) Act 2007.

The calculator uses Method 1 of the Measurement Determination to estimate the emissions and energy use for your corporation. The calculator then indicates if your corporation should apply to register under NGERS. 

The NGER calculator is available online and does not require a password for access.

Data entered during your session will not be retained when you exit the application. However, you can save a PDF copy of your assessment at the end of your session.

This spreadsheet tool estimates Solid Waste emissions according to Division 5.2.2 (Method 1) of the NGER (Measurement) Determination 2008.

Waste water calculator

This spreadsheet tool estimates Domestic and Commercial Wastewater emissions according to Division 5.3.2 (Method 1), and Industrial Wastewater emissions according to Division 5.4.2 (Method 1), of the NGER (Measurement) Determination 2008 as amended.

NGER registration application tool

The NGER Registration Application (RA) tool helps corporations prepare an application form to register under the NGER Act. The RA user guide provides step by step instructions and background information on how to use the RA tool.

The registration form must be signed by the CEO of the controlling corporation. It must then be sent by post to the Greenhouse and Energy Data Officer at GPO Box 854 Canberra ACT 2601 and received on or before the due date of 31 August 2009.

OSCAR

OSCAR is the Online System for Comprehensive Activity Reporting  It is designed to facilitate NGER reporting and collation of activity and other data required to be submitted in reports.

A contact specified by the corporation will receive the logon to OSCAR once your corporation is registered. The corporation is responsible for assigning and creating addition users to facilitate their reporting.

Sample Report

A sample report is provided as an example of the content of the final NGER report generated by OSCAR. This sample report is based on a ficticious corporation and is not representative of actual companies or facility operations. The content of a final NGER report is dependent on the data entered into OSCAR and whether data meets NGER thresholds.

Please note it is the responsibility of each user to protect the confidentiality of individual login details for OSCAR. The Department of Climate Change will not be liable for any damage or loss as a result of a user, the corporation a user represents, or a third party, improperly accessing OSCAR using the user's username and password. If you know or suspect that your login details have been compromised, or any other security breach has occurred, you should notify the Greenhouse and Energy Reporting Office immediately on 1800 018 831.

NGER Compliance and enforcement policy

The Greenhouse and Energy Data Officer (GEDO) has prepared the National Greenhouse and Energy Reporting Compliance and Enforcement Policy. The purpose of the policy is to inform stakeholders about how the GEDO intends to manage compliance and enforcement under NGER legislation.

NGER Forms

A number of forms are available to enable corporations to access various administrative processes under the National Greenhouse and Energy Reporting Act 2007.

Each form provides background information on the administrative process it applies to and basic instructions for use.
Each form can either be completed onscreen and printed off or printed off and completed by hand.
