The Government has consulted extensively with business, governments and the public to ensure the legislation is practical, workable and meets government, business and other data users' needs. The Government will continue to work with all stakeholders to ensure the legislation is implemented efficiently and effectively.

National Greenhouse and Energy Reporting (Measurement) Determination

The National Greenhouse and Energy Reporting (Measurement) Determination 2008 is currently being reviewed with the intention of elaborating and refining the instrument. Amendments to the Determination have been drafted to update particular elements for new information, elaborate the methods specified for the solid waste emission source and to respond to feedback received from stakeholders and from experience gained in the first year of implementation. The amendments will be applicable for the 2009—10 reporting year.

The intended amendments to the Determination have been grouped into three schedules as follows: Schedule 1 General amendments; Schedule 2: Amendments on waste; and Schedule 3: Minor amendments relating to UNFCCC Categories. A departmental commentary and a draft of the technical guidelines are also provided to assist in understanding the background, context and nature of the amendments.

Consequential amendments to the National Greenhouse and Energy Reporting Act 2007

The Government released the exposure draft of the Carbon Pollution Reduction Scheme legislation on 10 March 2009. This legislation includes the draft Carbon Pollution Reduction Scheme (Consequential Amendments) Bill 2009. This bill includes a number of amendments to the National Greenhouse and Energy Reporting Act 2007.

National Greenhouse and Energy Reporting Amendment Bill 2009 – Exposure Draft

An exposure draft of the National Greenhouse and Energy Reporting Amendment Bill 2009 was available for public comment. The bill is to strengthen the audit framework established by the National Greenhouse and Energy Reporting Act 2007 by requiring auditors to register with the Greenhouse and Energy Data Officer (GEDO). It also makes a number of administrative amendments to clarify audit arrangements. It will also remove the obligation on the GEDO to publish energy production data as outlined in the consultation paper released earlier this year.

Consultation paper on amendment to the energy production disclosure

The Department of Climate Change proposed to amend the National Greenhouse and Energy Reporting Act 2007 (NGER Act) by removing the requirement for the Greenhouse and Energy Data Officer to publicly disclose corporate level energy production data. The attached consultation paper was designed to inform stakeholders and seek feedback on the proposed amendment.

The proposed amendment addresses difficulties in providing meaningful corporate level energy production totals to the public. Registered corporations will still, however, be required to report energy production data to the Greenhouse and Energy Data Officer and this will be used to produce publicly available energy production statistics. The amendment is explained in detail in the consultation paper.

Amendments to the National Greenhouse and Energy Reporting Regulations 2008

Amendments to the National Greenhouse and Energy Reporting Regulations 2008 (the NGER Regulations) were required as a result of the passage of the National Greenhouse and Energy Reporting Amendment Act 2008, and also to make a number of minor edits and clarifications.

The amendments simplify requirements for applications for registration; move the location of the definition for ‘business unit’; establish requirements for identity cards for government authorised officers; clarify information to be provided by corporations for purposes of identification; address a number of inconsistencies in reporting requirements and correct formatting errors.

External Audit Consultation Paper

As part of the consultation process for the National Greenhouse and Energy Reporting System, the Department of Climate Change released for public comment the National Greenhouse and Energy Reporting Act 2007 and Carbon Pollution Reduction Scheme - External Audit Consultation Paper.

The consultation paper was designed to inform stakeholders and seek feedback on the development of external auditor regulations (professional expertise and qualifications) and external audit guidelines (conduct of audits and reports) under the National Greenhouse and Energy Reporting Act 2007 (the NGER Act). The external audit arrangements will support regulatory needs of both the NGER Act and the Carbon Pollution Reduction Scheme.

External Audit Workshops

The Department hosted a number of targeted stakeholder External Audit Workshops in late October 2008.

The purpose of the workshops was to utilise the expertise and experience of existing auditors (both greenhouse / environmental and financial / corporate) and reporting entities to aid the development of a robust and effective external audit framework for the National Greenhouse and Energy Reporting Act 2007 and the Carbon Pollution Reduction Scheme.
